Use of Information

In order to create a last will and testament with the BuildaWill™ application, you will need to provide FreeWills.com, (U.S.), Inc. d/b/a as Buildawill (the “Company”, “Buildawill”, “we” or “us”) with certain personally identifiable information and make certain choices about the provisions in the document. BuildaWill uses industry standard practices to safeguard the confidentiality of your personally identifiable information. The Company will keep your personally identifiable information for thirty (30) days after you last login to use BuildaWill™ so that you can complete or modify your will. After this thirty- (30) day period, the Company will delete any of such information that identifies you, your family and your additional individual beneficiaries by name or specific address, except in the case where a charitable or non-profit organization is named as a beneficiary in a will and you have directed the Company to notify such organization of your gift. If you authorize us to inform a beneficiary organization, we may share your personally identifiable information with our subsidiary companies in order to inform the organization(s) you list. By using BuildaWill™, you acknowledge and agree that BuildaWill may compile, distribute and/or otherwise retain and dispose of aggregate data based on information you provide including: (i) age; (ii) gender; (iii) relationship; (iv) jurisdiction; (v) types of gifts made by will; (vi) number of gifts made to immediate family; (vii) number of gifts made to other individuals; and (viii) number of gifts made to organizations. This aggregate data can not be used to identify you personally.

We respect the sensitive nature of children’s privacy online. We are a general audience web site and do not direct any of our content at children under the age of 13. If we have actual knowledge that a user of our web site is a child under the age of 13, we will promptly take steps to delete from our records any personally identifiable information about the child.

Though we make every effort to preserve User privacy, we may need to disclose personally identifiable information when required by law when we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on us. If we sell our company or its assets, we may transfer your personally identifiable information to the purchaser so that the purchaser can continue to provide services to you. The purchaser will be bound by the privacy policy set forth in this privacy statement.

Security

BuildaWill uses technical, administrative and physical measures to protect each and every User's personally identifiable information. A User's personally identifiable information is accessible online only with the username and password that the User provides, which is encrypted for additional security. Personally identifiable information that is stored at the Company's offices is restricted so that BuildaWill’s employees do not have access to such information, unless they need such information to perform their duties for the Company. We also encrypt our payment page so all credit card information is secure during the verification process. Furthermore, all employees are advised of BuildaWill’s security and privacy practices. Finally, the servers on which BuildaWill stores personally identifiable information are kept in a secure environment.

Cookies and Logged Files

Cookies are small bits of information that the Company's website puts on the hard drives of visitors in order to enable Buildawill to make visits to our website more useful. For example, BuildaWill uses cookies to identify which organization, if any, has linked a User to BuildaWill in order to customize the BuildaWill™ application. If a User rejects the BuildaWill cookie, they can still use the BuildaWill™. The only drawback is that they may not realize the full functionality of the BuildaWill™ as related to charitable bequests. The BuildaWill cookie is not set to collect any of the User's personally identifiable information, and remains on the User's hard drive for thirty (30) days. BuildaWill also logs IP addresses and browser types, and tracks a User's path through BuildaWill. This information does not include the User's personally identifiable information. BuildaWill uses this information to analyze trends, administer the site and gather broad demographic information for aggregate use.

Tell-A-Friend

If a User elects to use our referral service for informing a friend about BuildaWill, we ask the User for the User’s email address and the friend's email address. BuildaWill will automatically send the friend a one-time email inviting them to visit BuildaWill. BuildaWill uses the email addresses for the sole purpose of sending the one-time email and does not store the email addresses in any database.

This website contains links to other websites. Neither the Company nor any of its employees, agents or affiliates is responsible for the content, accuracy or opinions expressed in such other websites. Our privacy policy applies solely to information collection, disclosure and use by this web site.

Changes in Privacy Policy

If we decide to make a material changes to our privacy policy, we will post those changes to this privacy policy on this privacy policy page 30 days before implementing the change, so our users are always aware of what personally identifiable information we collect, how we use it, and under what circumstances, if any, we disclose it.
